Why would the bank do this to us?

My husband and I placed a bid on a short sale home in West Covina, Ca in June 2008. The current home owner has two loans on the house. The first bank accepted our offer within a few weeks. And just last week Oct 2008, the listing agent called our agent to tell him that the second bank had accepted our offer. Well...

This mess seems to be the listing agents fault. The person should be held responsible to give your deposit back. Its probably not a good idea to buy a house that has more than on lender owning it.
