Someone stoll my debit card. now the bank holds me responsible. wat should i do?

I lost wallet and someone stoll my washington mutural debit card. I accidently wrote my pin number on the back of the card and someone used my money. Now the bank says i owe money even though it wasn' t my fault. How should i handle this situation?

If you believe your Washington Mutual ATM Card, Debit Card or PIN has been lost, stolen or used without your permission, call us at one of the numbers shown at the end of these Account Disclosures and Regulations, or write to us at Washington Mutual, ATM/Debit, P.O. Box 1159, Northridge, CA 91328. If you believe an electronic funds transfer has been made using information from your check, or someone has or may transfer money from your account, or has drawn or may draw against your line of credit without your permission, call us at one of the numbers shown at the end of these Account Disclosures and Regulations, or write to us at Washington Mutual, ACH, P.O. Box 65934, San Antonio, TX 78265. The best way to notify us of suspicious or unauthorized access to your account is by telephone. Except, as set forth below, you could lose all the money in your account, plus your maximum line of credit and transfer authorization. Also, if your statement shows transfers that you did not make, or if you believe your receipt is wrong, tell us at once.
The following paragraphs (A) and (B) apply only to Consumer Accounts:
(A) If you do NOT tell us within sixty (60) calendar days after the first statement reflecting the suspect transaction or suspected error was mailed to you, you may not get back any money you lost after the sixty (60) calendar days (including credit advances on a line of credit or transfer made in accordance with a transfer authorization) if we can prove that we could have stopped someone from taking your money or using your Washington Mutual ATM Card, Debit Card or PIN without your permission if you had told us.
(B) If you tell us within two Business Days, you can lose no more than $50 if someone used your ATM Card, Debit Card or PIN without your permission. If you do not tell us within two Business Days after you learn of the loss or theft of your ATM Card, or Debit Card or possible misuse of your PIN, and we can prove that we could have stopped someone from using your ATM Card, Debit Card or PIN without your permission if you had told us, you could lose as much as $500.
(C) If a good reason (such as a long trip or hospitalization) kept you from telling us, we will extend the time periods. The provisions of the Customer Responsibilities and Limit On Time To Assert Claims section of these Account Disclosures and Regulations and Section 12 of this Electronic Fund Transfer Agreement and Disclosure apply to claims hereunder, including without limit claims under this Paragraph Number 4 and Paragraphs Number 8 and 9 of this section, except to the extent of any conflict; then this section applies. You agree to use any service, accounts, checks, cards (of any kind), Personal Identification Numbers (PINs) and any other instrument or card related to your account for lawful purposes only. Without limiting the foregoing, you agree that such may not be used for or otherwise in connection with any illegal transaction or activity. The Bank reserves the right to reject any transaction it reasonably believes to be unlawful or attempted in connection with any transaction it reasonably believes is unlawful.

If I am reading this correctly, then as long as you told them that the card was missing within 2 business days, they cannot hold you liable for anymore than $50. Even if your PIN was written on the back (which by the way, I have to agree was really not very smart) Good luck and I hope this helps!

You put your pin on the card so there not much you can do. Have the bank stop the card and get you a new card and don't put your pin on it and pay what is owe,sorry but you are at fault. If you did not have your pin # on it you could get out of paying for it.

If you reported the loss, the bank should have immediately cancelled your card. If you did not report the loss, then the bank will tag you for the overdraft. If the card is still being used, call immediately and cancel it. The same thing happened to a relative of mine. The bank froze her overdrawn account and now she can't open an account at another bank.

why should a bank be liable for it, its completly your fault. you wrote the pin number. when you knew your wallet is being stolen, why you didnt call the bank right away. if something like this happens, banks usually cancels the card.
and by the way what kind of person can't remember a four digit pin number. thats just plain stupid.

I'm sorry but if you write you PIN number on the back of your debit card you deserve to have it stolen. That is not smart. Youre screwed unless you have some kind of insurance and proof. Which you wont have any of.

You "accidently" wrote your PIN number on the back of the card? I agree with the bank.

Since a debt card can only take the money that you deposited to your account, how could you owe money to the bank??

It is not borrowed money from the bank

It is like losing all your cash

have them provide you with proof you did the action. also your home owners ins. covers the cost of a lost or stolen card in most cases if you have it reported.

You should make then produce the ATM tape if the WD was from a machine.

you should not write your pin on your card(not even accidently)....aside from that...............debit card takes money from your account...no money...no take.......................................
I hate WaMu............................did you report it right away?????why not?
