It must be company policy.
Many banks won't cash checks written in felt tipped pens, due to the ease with which such inks can be removed and altered. It's a common policy.
Now as to the real problem. You're trying to get them to cash a check, without having an account with them, so they've chosen to go with the option that is least likely to burn them. Most banks today will cash an image of a check, as long as you have an account, so it's obvious you don't.
It's considered a financial instrument. I don't believe it falls under the definition of a legal document, per se.
It is a legal request for payment. I'd say yes.
